SpillHerTea – Terms of Service

Effective Date: August 18, 2025

Entity: SpillHerTea LLC, a U.S. limited liability company (“SpillHerTea,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your use of the SpillHerTea mobile application, website, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be 16 years or older to use SpillHerTea.

By using the Service, you represent that you are legally able to enter into this agreement in your jurisdiction.

2. Account Registration

You must register with a valid phone number.

You may also set a username, display name, or handle.

You are responsible for all activity on your account.

3. User Content

You may post reviews, flags, polls, images, or comments (“User Content”).

You retain ownership of your User Content but grant SpillHerTea a worldwide, royalty-free license to display, distribute, and operate the Service.

You agree not to post:

Reviews are user opinions only and not verified facts. SpillHerTea does not endorse or guarantee User Content.

4. Moderation

Content is moderated by both AI and human reviewers.

We may remove, edit, or restrict access to content or accounts at our discretion.

We do not guarantee immediate removal of reported content. Investigations may take up to 60 days.

5. Notifications

If your post receives comments or reviews, we may notify you via in-app alerts, push notifications, or email.

6. Biometric Verification

To verify liveness and gender, SpillHerTea may collect and store face indices and gender verification results (binary male/female).

By using the Service, you consent to this biometric processing.

Verification is one-time, unless you delete and re-create your account.

We do not sell or share biometric data.

7. Subscriptions & Payments

The Service is free with optional freemium and subscription features.

Subscriptions are billed via Apple App Store and Google Play Store.

Refunds are handled according to the policies of the app stores. SpillHerTea does not process refunds directly.

8. Reverse Image Search & Images

You may upload images for review or history checks.

By uploading, you represent you have rights or legitimate interest to share the image.

SpillHerTea is not responsible for unauthorized image uploads.

We may use in-house tools and third-party APIs to perform reverse image searches.

9. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.”

SpillHerTea does not guarantee accuracy, reliability, or completeness of User Content.

We are not responsible for decisions you make based on the Service.

10. Limitation of Liability

To the maximum extent allowed by law, SpillHerTea’s liability is limited to the amount you paid us in the past 12 months, or $0 if you use the free Service.

We are not liable for indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify and hold harmless SpillHerTea, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Service or your User Content.

12. Dispute Resolution & Arbitration

Binding Arbitration: All disputes will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA).

Class Action Waiver: You agree not to participate in any class action, collective, or representative lawsuit against SpillHerTea.

Global Coverage: If you reside outside the U.S., local consumer protections may apply in addition to these Terms, but arbitration still governs disputes with SpillHerTea.

13. Termination

You may delete your account at any time.

We may suspend or terminate accounts that violate these Terms or applicable law.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service means you accept the new Terms.
